The initial fillings have been received for a potential recall vote against Wayne County Commissioner Dean Burbach.
In August, Burbach admitted to spending nearly $250 in county Menards rebates for personal use.
A recall affidavit, the first step of the process for recall vote, has been received by Wayne County Clerk Joni Tietz.
Affidavit language states: “Commissioner Burbach misused County rebates for personal gain, violating Neb. Rev. Stat 49-14,101.01(2) prohibiting use of public property for personal financial benefit. He admitted improper handling of public funds and gave misleading responses to auditors. His actions breach public trust and legal standards, justifying recall due to ethical misconduct and potential statutory violations.”
Burbach has 20 days to file his own statement of defense.
After the 20 days is up, the principal circulator has 30 days to gather signatures from at least 35% of the total vote cast for that office. A total of 802 people voted for this office in the general election, meaning the circulator must gather 281 signatures.
Burbach ran unopposed in this race.
After the signatures are verified, a special recall election can be called, Tietz said.
